Lifetyme Seed Company offers grass seed, agricultural, garden, and related products. Product descriptions, images, and pricing may occasionally contain typographical errors, and we reserve the right to correct such errors without liability.

4. Ordering and Payment

By placing an order, you represent that all information you provide is accurate and complete, and that you are authorized to use the payment method provided. We may cancel or refuse any order for reasons including, but not limited to, suspected fraud, pricing errors, or product unavailability. Full payment is required at checkout. We accept major credit cards and other payment methods as displayed on the Site.

5. Shipping

Shipping times are estimates and are not guaranteed. Lifetyme Seed Company is not responsible for delays caused by carriers, weather, agricultural inspections, or other factors beyond our control. 6. Returns and Refunds

All seed sales are final. Our complete Refund & Return Policy is available on our website and is incorporated into these Terms by reference. By purchasing from us, you acknowledge and agree to the terms outlined in that policy.

 

7. Seed Laws, Regulations, and Compliance

Grass seed products may be subject to federal, state, or local agricultural regulations, including restrictions on importation into certain states. You agree that you are solely responsible for complying with all applicable laws and regulations in your jurisdiction. Lifetyme Seed Company is not liable for purchases made in violation of applicable agricultural laws.

8. Intellectual Property

All content on the Site — including text, images, logos, product descriptions, and graphics — is the property of Lifetyme Seed Company or its licensors and is protected by applicable copyright and trademark laws. You may not copy, reproduce, distribute, modify, or use any content without our prior written permission.

9. Prohibited Uses

While our seeds meet or exceed legal germination rate requirements, germination and growth outcomes depend on environmental variables outside our control. 11. Limitation of Liability

To the fullest extent permitted by law, Lifetyme Seed Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or products. Our total liability for any claim arising from a product purchase is limited to the amount you paid for that specific product.

12. Dispute Resolution — Arbitration

Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute through good-faith negotiation. If negotiation fails, any dispute, claim, or controversy arising from or relating to these Terms or your purchase shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA), rather than in court.

Exceptions to this arbitration requirement include: (a) claims that qualify for small claims court; and (b) requests for injunctive or equitable relief to protect intellectual property rights. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes not subject to arbitration will be resolved exclusively in the state or federal courts located in Tazewell or Peoria County, Illinois.

14. Indemnification

You agree to indemnify, defend, and hold harmless Lifetyme Seed Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or related to your misuse of the Site, violation of these Terms, or infringement of any third-party rights.
